Congress, CSPI Call for Federal Action on Bacteria

News outlets reported that, because of the most recent ground beef recall that sickened 14 people last week due to an antibiotic-resistant strain of Salmonella, Congresswoman Louise Slaughter and the Center for Science in the Public Interest (CSPI) are petitioning for federal action on the increasing threat to public health from these bacteria.

Slaughter issued a statement saying, “When we go to the grocery store to pick up dinner, we should be able to buy our food without worrying that what we put on our plates is exposing out families to dangerous antibiotic-resistant bacteria. How much longer is the federal government going to wait before waking up to the public health threat, looking quite literally, under our nose? We have a duty to protect the public health, and frankly the foot-dragging we are seeing on this issue here in Washington is legislative malpractice.”

The CSPI is lobbying from a different perspective, petitioning the US Department of Agriculture’s Food Safety and Inspection Service (FSIS) to declare that specific antibiotic-resistant strains of Salmonella are adulterants, effectively making them illegal in meat and poultry products. The CSPI said, “That declaration would trigger enhanced testing for these dangerous pathogens, and could minimize their entry into commerce.”

As a Shippensburg personal injury lawyer, I know how important it is to ensure that the food found in stores is safe for consumption due to past experience with food safety recalls. If you’ve suffered adverse health symptoms because of consuming a contaminated or otherwise defective food product, call a personal injury lawyer in your city to discuss the legal avenues open to you.

E&B Giftware Pays Civil Penalty for Failing to Report Defect

News agencies reported that E&B Giftware consented to pay the civil penalty of $550,000 in order resolve allegations from the US Consumer Product Safety Commission (CPSC) that the company failed to immediately report a defect with their fitness balls.

The defective fitness balls could potentially explode if over-inflated, posing a general injury hazard to consumers. While agreeing to pay the civil penalty, E&B denies the allegations of the CPSC that the company knowingly violated the law. The CPSC staff claim that EB Brands, a E&B subsidiary, knew of the defect and subsequent 25 incidents back in 2007, but did not report this to the CPSC as per federal law. By the time EB Brands reported the defect to the CPSC in October of 2008, the company had received more than 44 reports of incidents with the defective fitness balls.

Three million of the defective fitness balls were sold between May 200 and February 2009. They were recalled in April of 2009. At the time of their recall, 47 reports of incidents where the balls burst, resulting in injury, had been received.

The CPSC stated, “Federal law requires manufacturers, distributors ad retailers to report to CPSC within 24 hours after obtaining information reasonably supporting the conclusion that product contains a defect which could create a substantial product hazard, creates an unreasonable risk of serious injury or death, or fails to comply with any consumer product safety rule or any other rule, regulation, standard or ban enforced by CPSC.”

As a Lewistown personal injury lawyer, I’ve witnessed similar situations of allegedly delayed recalls and know the dangers of those situations. If you’ve been injured by using a defective product that you feel should have been previously recalled, speak with a personal injury lawyer with experience in these matters.

Self-Awareness Exercises Found to Decrease Fibromyalgia Pain

Recent studies have shown that self-awareness intervention and therapy can significantly decrease pain for fibromyalgia patients.

The study included 45 women diagnosed with fibromyalgia, a chronic disorder with symptoms of excessive pain, tenderness, headaches and fatigue. The women were put into either an “affective self-awareness” group or a control group that would receive no treatment. The treatment group and control group had no significant differences in demographic or medical history.

The “affective self-awareness” group received a single 90-minute consultation with a doctor, then subsequent 2-hour weekly sessions once a week for three weeks. The sessions were made up of anywhere from 8 to 12 women and led by a doctor. The sessions consisted of educating the women on the psychophysiological model of physical pain in fibromyalgia, featuring support from case studies, homework for the women in the form of 30-minutes writing sessions concerning their emotions and stress, practicing affective awareness techniques and reintroducing the women to activities they’ve avoided due to the fibromyalgia symptoms.

A pain inventory scale, including tenderness-threshold scale and physical function evaluation, was given to each woman at the start of the study, then immediately after treatment and again six months after completion. Almost half of the “affective self-awareness” group experienced a 30 percent or greater reduction in the pain they experience, compared to none in the control group.

As a Los Angeles neurologist, I’m glad that this issue is being addressed to aid patients suffering from fibromyalgia symptoms. If you experience chronic pain, it may be in your interests to speak with a pain management doctor.

CPSC Aims To Make Gel Fuels And Firepots Safer

According to news sources, The Consumer Product Safety Commission (CPSC) is aiming to make gel fuels and firepots safer for consumers by voting to begin publishing advance notices of proposed rulemaking to the public.

Consumers using gel fuel run burn risks when pouring it into an already lit firepot, since the gel can unexpectedly ignite and splash onto the users face or body. There have already been about 65 incidents reported between April 2010 through September 2011 relating to the use of the product. Of those incidents, two resulted in death and about 34 cases resulted in second and third degree burns of different body parts.

The measure would allow the public 60 days from the time of publication of any proposed rules to discuss the different safety aspects as well as the risks involved with using the product.

The CPSC began the process of investigating burn accidents resulting from the use of firegel products last June.

As a personal injury attorney Los Angeles, I understand the inherent dangers of defective products and the risks they entail. FDA Safety Warning For Multaq, A Heart Rhythm Drug

According to news sources, the drug Multaq is getting a new safety warning after a study found increased risks of heart attack, stroke and death associated with the drug with a subset of patients that took part in the study.

The heart rhythm drug controls the heart’s chambers by allowing them to pump in sync for patients with atrial fibrillation. The new warning would allow the drug to remain on the market but would stress to doctors and patients that it be used only for treatment of the short-term variant of the condition. People with permanent atrial fibrillation were shown to double their risks of heart-related complications by using the drug.

The Food and Drug Administration has written the warning label with the drug-maker, Sanofli, urging doctors to check their patients heart rhythms once every three months to ensure that no adverse effects are taking place. As for patients who have the long term variant of the condition, the FDA is recommending that they discontinue the drugs use.

The FDA also said that the drug continues to be beneficial to patients.

As a personal injury lawyer Los Angeles, I appreciate all efforts being made to ensure increased drug safety standards for everyone . I hope this information can help raise awareness about this product and keep consumers safe. Physical Therapy Not Only for Rehabilitation

According to a new study, roughly half of the patients seen by physical therapists are being treated for ailments not related to rehabilitation.

Blain Stimac, owner and CEO of Professional Therapy Associates, said, “Physical therapy is widely recognized for its effectiveness in helping patients recover and regain full mobility after an injury, severe illness or surgery. However, it’s a common misconception that physical therapy is only used for rehabilitative purposes- statistically, one in two patients visit us for reasons other rehab. Our physical therapists are experts at rehab therapy, but they also treat patients for conditions ranging from chronic pain, arthritis and repetitive strain to headaches, sleep problems and balance issues. They also provide strength, flexibility and endurance training to athletes and individuals looking to improve their overall health and fitness.”

Physical therapy can be a useful tool in treating many common ailments like back pain. Having a chiropractor correct the immediate issue will ease the pain for a short period of time; however, unless an effort is made to strengthen and stabilize the area of the back that is affected, the pain will return. Therapy can also aid those that suffer from arthritis by helping patients to learn different movements, exercises and stretches that will minimize pain and stiffness while strengthening muscles that support the joints.

As a back pain doctor, I know how important it is to address the underlying issue of different types of chronic pain to strengthen core muscles and keep the pain from returning. If you suffer from a type of chronic pain, speak with a pain management doctor to aid in reducing your pain on a daily basis.
